Full Terms & Conditions (2026)

By placing an order with Fayette Studio, the Purchaser acknowledges and agrees to the Terms and Conditions in effect on the date the order is accepted by Fayette Studio. Fayette Studio reserves the right to modify or update these Terms and Conditions at any time. Customers are encouraged to retain a copy of the Terms and Conditions applicable to their order for their records. For purposes of these Terms, "Purchaser," "Customer," and "Client" refer to the person or entity who is sent the invoice and is placing the order. Any receiver, warehouse, contractor, designer, homeowner or other third party designated by the purchaser acts on the purchaser's behalf.

All orders are considered firm once Fayette receives a deposit. Deposits are non-refundable. 

Ordering and production

Custom rugs

Custom rugs are FINAL SALE. A non-refundable 50% deposit is due to begin custom artwork and launch a strike off.  Balance is due before full production. Production timelines begin after all approval and required payments have been received. Rush order fees are nonrefundable and do not guarantee early delivery if circumstances beyond our control affect production time. 

Fayette Studio does not accept cancellations of custom or special orders once a deposit has been received. Upon receipt, the deposit is immediately earned and applied toward design services and costs incurred or committed in connection with the order, regardless of whether final design details or approvals have been completed.

A deposit reserves your project based on the specifications and pricing in effect at the time of the estimate. Any design details, color selections, dimensions, materials, or other specifications that remain unconfirmed must be finalized within fourteen (14) days of the deposit. After fourteen (14) days, pricing, lead times, material availability, freight, tariffs, and other project costs are subject to change, and Fayette Studio reserves the right to issue a revised quote before proceeding. Finalizing specifications that were intentionally left open or unconfirmed at the time of deposit does not constitute a Change Order. However, if such specifications are not finalized within fourteen (14) days, the revised pricing and other terms then in effect shall apply, and the Purchaser shall remain bound by the order and these Terms and Conditions.

Change orders

A Change Order is any Client-requested change to the original order after a deposit has been received, including but not limited to changes to the design, color, materials, construction, dimensions, pattern direction, pile height, shape, border, finishing, delivery, or other specifications.

All Change Orders are subject to Fayette Studio's approval. Once a deposit has been received and production documents or renderings have been requested or approved, requested changes may not be possible.

A $350 Change Order Fee applies to each approved Change Order to cover the administrative work required to process the requested change, including revising quotations, coordinating with manufacturers and vendors, updating production documents, and managing project revisions. The Client is also responsible for any additional costs incurred by Fayette Studio or its manufacturers as a result of the requested change.

A Change Order should not be expected to result in a reduction in price. Fayette Studio is under no obligation to reduce the purchase price as a result of a requested change. Any price adjustment, if granted, is rare and made solely at the discretion of Fayette Studio based on the stage of production and costs already incurred or committed. A reduction in size, materials, or scope does not necessarily result in a reduction in price.

If Fayette Studio elects, in its sole discretion, to grant a price adjustment, it will be issued solely as a non-refundable credit toward a future custom order. Credits expire six (6) months from the date of issue unless otherwise stated in writing, are not redeemable for cash, and must be requested by the Client prior to placing a subsequent order.

Once signed production documents or renderings have been issued to a manufacturer, Fayette Studio cannot guarantee that requested changes will be implemented. If a manufacturer produces the rug in accordance with the original approved rendering or production documents, Fayette Studio shall not be responsible for any resulting errors, costs, or delays.

Strike offs

A strike-off is a small pre-production sample that confirms the colors, materials, texture, pile, construction, and overall design intent before full production begins. Because custom rugs are made specifically to order, it is normal for a strike-off to require revisions to achieve the desired result. If the strike-off does not accurately reflect the approved specifications, Fayette Studio will work with the Purchaser to revise and produce a new strike-off. If the strike-off accurately reflects the approved specifications but the Purchaser wishes to make changes or prefers a different look, any revisions will be treated as a Change Order, and additional charges, including the cost of a new strike-off, may apply. A Purchaser's dissatisfaction with a strike-off does not constitute grounds to cancel a custom order or receive a refund of any deposit.

For custom colors and custom patterns, we strongly advise making a strike off. Strike offs will ship approximately 4-6 weeks after a render is approved. Ombre, new or complicated designs take additional time. Strike off pricing will be on the estimate or invoice and any additional strike offs will be billed at that strike-off rate. If no strike off rate is listed, it is a $350 fee per strike-off.

Strike offs must be approved within thirty (30) days of Fayette’s notification that the strike off is available for review. Delays in approval may result in changes to pricing and/or production timelines.

All required approvals, signed renderings, deposits, and final payments must be received within the timeframes requested by Fayette in order to maintain the pricing quoted on the original invoice. Delays caused by the client, including delays in providing required information, or submitting required payments, may result in changes to the original pricing due to changes in materials, labor, vendor costs, freight, or other costs applicable at the time production begins.

When a strike off on a custom rug order is waived, the client is fully responsible for the delivered rug. By waiving a strike off, the client accepts responsibility for color, texture, and appearance variations that could have been identified through a strike off. The invoice must be paid in full before full size rug production.

Materials

Natural materials / handmade products

Variations in color, texture, appearance, and size are inherent to handmade rugs and are not considered manufacturing flaws but rather contribute to the unique character of the handmade product.

Due to the nature of handmade products, variations of approximately ±5% in color and size are considered acceptable. Exact sizes are not possible in handmade rugs unless larger sizes are ordered and cut down after production. This is if the pattern allows and is at an additional cost. Please note that even cut downs may still have slight variation but will be as close to the ordered size as possible. 

Shearlings, leather & fur

Natural hides, leather and fur can vary in color, texture, softness and pile height. These variances are natural occurrences in skins/hides and therefore an exact match to your sample cannot be guaranteed. Natural hides should never be in direct sunlight and can fade/discolor. It is normal to have a slight odor detectable with natural hides. It is expected for dyed hides to oxidize and change in color with age. These rugs are not recommended for homes with pets.

Undyed wool

Natural wool colors can have variation in tonality and may not match the control sample exactly. It is common for natural yarns to have striations and variation throughout the rug. 

Custom machine made carpets and rugs

Although the mill does their best to keep dye lots consistent, standard colors can have dye lot variation between the strike off and the final carpet/rug. 

Stocked broadloom

Dye lot variations are common and expected. CFAs are recommended and may incur a charge (for each cutting) depending on the mill. 

Fayette is not responsible for color variations, selection errors, or discrepancies that would have been identified through review and approval of a CFA if the client chooses to proceed without one.

Delivery & installation

Wall to wall installation

For a proper fit, carpet must be installed tightly to the wall. This may require minor wall and/or base molding touch-ups after installation which is the responsibility of the client. Any special finishes or wall coverings that cannot be touched up should be installed after carpet installation. In wall-to-wall carpet installations, minor scuffs or touch-ups are considered a normal part of the process and are not something we can take responsibility for.

Scheduling & installation

Please allow up to six (6) weeks to schedule a delivery or installation. Fayette Studio schedules installations only after the carpet and all necessary accompanying materials have been received and inspected. Fayette Studio may, in its sole discretion, schedule an installation before all materials have been received or inspected. Any such accommodation is made solely as a courtesy, does not constitute a waiver of this policy, and shall not create any expectation or obligation for Fayette Studio to do so in the future.

Installation time windows, if provided, are confirmed the afternoon before the scheduled date.. If confirmation is not received, the Purchaser should contact Fayette Studio before 5:00 p.m. at info@fayettestudio.com or 203-769-1617. Arrival times are estimates only and may vary due to traffic, weather, prior installations, location, or other circumstances beyond Fayette Studio’s control. Arrival times and installation time windows are not guaranteed.

An authorized representative with authority to make binding installation and design decisions must be available at the beginning of the scheduled installation window to provide timely direction regarding rug placement, pattern direction, orientation, stair-runner margins, and any other installation details. If the Purchaser or an authorized representative will not be present, complete written installation instructions must be provided when the installation is scheduled.

Direction may be provided remotely in limited circumstances; however, remote communication may not capture all relevant conditions or details, may delay the installation, and may not be possible due to connectivity or communication issues. This is particularly important for stair runners and other materials that are cut or permanently installed, as adjustments after installation may not be possible.

If an authorized representative is unavailable or fails to provide timely instructions, approvals, or decisions, Fayette Studio may, in its sole discretion, postpone, cancel, or proceed with the installation based on the installers’ reasonable judgment and customary installation practices. Installers are skilled tradespeople, not design professionals, and are not responsible for aesthetic, design, layout, or placement decisions.

Any installation or placement decisions made in the absence of timely direction shall be at the Purchaser’s sole risk. Fayette Studio shall not be responsible for dissatisfaction resulting from the absence of proper instructions or from a later preference for a different placement, orientation, margin, layout, or design decision.

Any request made after installation to change the placement, orientation, layout, margins, or other design decisions, including any installation or placement decisions made by the installers in the absence of timely direction, shall be treated as a new service request. Any resulting labor, travel, removal, reinstallation, additional materials, or other costs shall be the sole responsibility of the Purchaser. Fayette Studio cannot guarantee immediate availability or the Purchaser's preferred timing for return visits.

If the installer determines that the work cannot reasonably or safely proceed because of insufficient direction, delayed decisions, site conditions, interruptions, or other circumstances beyond Fayette Studio’s control, the installation may be suspended or rescheduled. The Purchaser shall be responsible for all resulting charges and expenses, including additional labor, waiting time, cancellation or missed-trip charges, return visits, travel, removal, reinstallation, replacement or additional materials, storage, re-delivery, and any other related costs. Fayette Studio cannot guarantee immediate availability or the Purchaser’s preferred timing for a return visit or rescheduled installation.

Schedule, access, scope, or other changes communicated fewer than two (2) business days before a scheduled delivery or installation may result in cancellation, rescheduling, travel, labor, or other applicable charges.

Jobsite preparation, access & additional labor

The Purchaser is responsible for ensuring that the installation area is fully prepared before the crew arrives and that Fayette Studio and its installers have safe, clear, and uninterrupted access to the work area for the duration of the installation.

The installation area must be free of ongoing construction, other trades, excessive foot traffic, repeated interruptions, blocked access, unsafe conditions, obstructions, unreported furnishings, and furniture that Fayette Studio has not agreed in advance to move. Installations are scheduled based on the expectation that the installers will be able to work continuously and efficiently without interruption, clearing the area, or waiting for access, instructions, approvals, or decisions.

If delivery or installation is delayed, interrupted, suspended, or cannot be completed as scheduled due to conditions beyond Fayette Studio’s control, the Purchaser shall be responsible for all resulting charges and expenses. Such conditions include, without limitation, ongoing construction; other trades or occupants using the work area; repeated interruptions by the Purchaser, homeowners, occupants, contractors, or other persons; blocked or restricted access; an uncleared or unsafe workspace; unreported or excessive furnishings; insufficient site preparation; or the failure to provide necessary instructions, approvals, or decisions.

Resulting charges may include additional labor, waiting time, missed-trip or missed-day charges, cancellation or rescheduling fees, return visits, travel, storage, re-delivery, removal, reinstallation, and any other expenses incurred by Fayette Studio or its installers. Fayette Studio is not responsible for delays, incomplete work, or additional costs resulting from site conditions, interruptions, restricted access, or other circumstances beyond its control.

Delivery and installation pricing is based on the scope of work stated in the invoice, the conditions and furnishings disclosed when the work was quoted, and the handling of standard furnishings only. Additional labor, personnel, equipment, preparation, or time required to safely and properly complete the work may result in additional charges.

Additional charges may be determined and billed after the delivery or installation when the conditions requiring additional work or time are first discovered onsite. Examples include moving unreported furnishings, clearing or preparing the work area, addressing unexpected site conditions, waiting for access or decisions, or spending additional time at the Purchaser’s request reviewing multiple rug placements, orientations, margins, layouts, or design options.

Fayette Studio is not responsible for pre-existing conditions at the installation site, including uneven or damaged flooring, irregular surfaces, structural limitations, concealed conditions, or other conditions that may affect the installation process or the appearance or performance of the completed work. Measurements, recommendations, and quotations are based solely on conditions that are visible and reasonably observable at the time Fayette Studio measures or inspects the site. Fayette Studio is not responsible for conditions that become apparent only after existing flooring or other materials are removed, including, without limitation, gaps beneath baseboards or trim, exposed walls or finishes, floor-height differences, concealed defects, or other conditions resulting from prior construction, previous flooring installations, or installation methods. If any such condition is discovered before installation, or if any repairs, floor preparation, structural modifications, carpentry, trim work, painting, or other corrective work will be required before installation can proceed, the Purchaser must notify Fayette Studio at least two (2) business days before the scheduled installation. Any such corrective work must be completed, and the installation area must be ready for installation, before the scheduled installation unless otherwise agreed in writing by Fayette Studio. Fayette Studio is not responsible for identifying or performing structural modifications, floor preparation, carpentry, painting, trim work, shaving doors for clearance or any other corrective work required to accommodate the selected flooring or to address such conditions. The Purchaser is solely responsible for arranging and completing all such work. If installation is delayed, interrupted, or additional labor is required because of these conditions or the need for corrective work, the Purchaser shall be responsible for all resulting costs, including removal, reinstallation, return visits, additional labor, travel, storage, and any other related expenses.

Furniture moving

Heavy, oversized, fragile, antique, custom, or high-value furnishings (including artwork, electronics, collectibles, and personal belongings) should be removed or secured by the purchaser prior to installation whenever possible.

If furniture must be moved during delivery or installation, reasonable care will be used; however, Fayette Studio is not responsible for damage resulting from ordinary handling, hidden defects, weakness, instability, improper assembly, loose joints or hardware, prior repairs, age-related deterioration, or other pre-existing conditions that are not reasonably apparent before the item is moved, except to the extent such damage is directly caused by the negligence or willful misconduct of Fayette Studio or the installers performing the work.

Furniture moving does not include disassembly, reassembly, repair, or adjustment of furniture unless specifically agreed in advance.

Installers are not authorized to approve, waive, or modify Fayette Studio's pricing. Requests made directly to installers for work outside the original scope may result in additional charges billed after completion.

Gratuities are appreciated but never expected. A gratuity provided to installers does not constitute payment for additional services or changes to the agreed scope of work.

Increase in installation costs

Installation and delivery rates are subject to change. If installation or delivery does not occur promptly due to the Client's schedule or project delays, the Client is responsible for any increase in labor, material, fuel, freight, or other installation-related costs incurred before installation takes place. Any such increases will be communicated to the Client before installation.

Shipping

Fayette cannot determine the exact shipping cost until the rug has shipped. Included freight costs are estimated and may increase at or after the time of shipping. We will do our best to honor the price on our invoice, but Fayette reserves the right to adjust freight costs and related charges such as government-imposed tariffs, duties, taxes, customs fees, or carrier surcharges. Quoted delivery dates are approximate dates only. Fayette shall not be responsible for any delay in delivery or failure in performance for any cause beyond Fayette’s direct control (including, but not limited to, labor disputes, failure or delay of sources to supply, transportation difficulties, health emergencies, accidents, fires, acts of nature) or any event which interferes with Fayette’s or its vendors’ normal business operations. 

Oversize area rugs typically need to be crated for transit. This cost is typically communicated to Fayette once the rug has been woven. There are also additional costs to break down and dispose of crates. 

Storage and unclaimed orders

Fayette Studio understands that clients may not be able to accept delivery immediately once notified that their rug is ready. Any rug or carpet not accepted for delivery within thirty (30) days after such notice will be subject to storage fees. Storage fees are due upon request, regardless of whether delivery has been scheduled.

Storage fees include a minimum $125 re-inspection fee plus $50 per rug per month. Fayette Studio is not responsible for crushing, wrinkling, fading, deterioration, or other conditions that may occur while goods remain in storage. Additional services, including blocking, cleaning, or preparation for delivery, may result in additional charges.

Fayette Studio may, as a courtesy and at its sole discretion, store a rug or carpet for up to one (1) year, provided the Purchaser remains in communication and timely pays all requested storage fees. Storage beyond one (1) year is not guaranteed. After one (1) year, Fayette Studio may require the Purchaser to arrange immediate delivery or pickup within a reasonable period specified by Fayette Studio or, in its sole discretion, agree to continue storage subject to ongoing storage fees and any additional terms Fayette Studio may require.

An order will be considered unclaimed only if the Purchaser (i) fails to pay requested storage fees for more than ninety (90) days after payment is requested, or (ii) after Fayette Studio has required delivery or pickup, fails to arrange delivery or pickup within the time specified by Fayette Studio and, despite at least three reasonable attempts by Fayette Studio to obtain payment or arrange delivery or pickup, fails to respond. Fayette Studio may then cancel the order without refund and donate, sell, or otherwise dispose of the goods. The Purchaser remains responsible for all outstanding balances, including storage fees and any other applicable charges.

Delivery/shipping to third-party receiver

Delivery of the merchandise to a receiver designated by the Purchaser constitutes delivery to and acceptance by the Purchaser. The receiver must inspect the merchandise immediately upon receipt.

Any visible defects, shortages, errors, damage, or other non-conformities must be reported to Fayette Studio in writing within five (5) business days after delivery. This requirement applies whether the merchandise was inspected by Fayette Studio before shipment or shipped directly from the manufacturer or mill. Failure to provide timely written notice constitutes acceptance of the merchandise as delivered.

Rugs stored by a receiver for an extended period may require airing out or steaming to remove creases or crush marks. When practical, Fayette Studio may pre-steam rugs before storage or shipment; however, any additional steaming or conditioning required after delivery is the responsibility of the Purchaser or receiver.

Fayette Studio is not responsible for mishandling, damage, improper storage, delays, environmental conditions, or any other acts or omissions of the receiver or any third party after delivery to the designated receiver.

Payment

Fayette gladly accepts checks, bank transfers, wire transfers and credit cards. Please note our estimates/invoices include a 3% discount for payments made using a checking account and if you choose to pay with a credit card, this discount will be removed prior to payment.

Quotes are valid for 30 days.

If payment is not made within ten (10) days of the final payment notification, a late fee of 1.25% per month may be charged by Fayette. If balance payments are not made within 3 months of request, Fayette has the right to cancel the order and retain the deposit. 

Late fees and any other applicable charges will continue to accrue until all outstanding balances are paid in full. Fayette is not responsible for loss, damage, deterioration, or other issues affecting goods held due to delayed payment, delayed acceptance, or failure to take delivery. If goods must be replaced, reordered, remade, or additional services are required due to delays caused by the purchaser, the purchaser will be responsible for any resulting additional costs, including but not limited to increased production costs, freight, tariffs, storage, or related charges.

Customers will be liable for all reasonable costs, expenses, fees, including reasonable attorneys’ fees, incurred by Fayette in collecting monies due. 

Claims and legal

Claims

All claims against Fayette Studio, including but not limited to claims for damage, defects, shortages, errors, delivery discrepancies, or installation issues, must be made in writing within five (5) business days after delivery or installation. Failure to provide timely written notice constitutes acceptance of the merchandise and, if applicable, the installation.

Fayette Studio's total liability for any claim shall not exceed the amount actually paid to Fayette Studio for the merchandise giving rise to the claim.

No oral modifications or warranties

Any oral or written statements made by a Fayette Studio employee, representative, installer, or agent do not constitute warranties, guarantees, representations, or modifications of these Terms and Conditions and may not be relied upon unless expressly confirmed in writing and authorized by Fayette Studio's owner.

Intellectual property and design ownership

We create many original designs for our clients. The following section explains ownership of those designs and how they may be used.

Ownership of Designs. Custom rug designs, artwork, patterns, layouts, modifications, adaptations, and other creative elements (collectively, the "Designs") created by, for, or commissioned by Fayette Studio, including Designs created in collaboration with a client or based in whole or in part on client-provided concepts, inspiration, or artwork, remain the exclusive property of Fayette Studio. Purchasing a rug gives the client ownership of the physical rug only. It does not transfer ownership of the underlying Designs or any intellectual property rights, including without limitation any copyrights, trademarks, trade dress, or other proprietary rights associated with the Designs.

Honorary Naming. Naming a design, rug, or collection after a client or project is honorary only and does not create or imply any ownership, intellectual property rights, exclusivity, or entitlement to compensation or royalties.

Client-Supplied Artwork. If a client provides finished artwork (including drawings, designs, or patterns), the client may request in writing that Fayette Studio not reproduce or display that artwork. Unless Fayette Studio receives such a written request before production begins, Fayette Studio may reproduce, distribute, display, modify, prepare derivative works from, adapt, license, and otherwise use the artwork for future projects, collections, marketing, advertising, and other business purposes, without compensation, royalties, or other obligation to the client.

Client Warranty on Supplied Materials. The client represents and warrants that any artwork, designs, logos, photographs, inspiration images, or other materials it supplies for a project may lawfully be used by Fayette Studio for the requested project and do not infringe the intellectual property or other rights of any third party. The client agrees to indemnify, defend, and hold harmless Fayette Studio from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to the client's submission or requested use of such materials.

Restrictions on Third-Party Use. Designs created by Fayette Studio — including modified, adapted, or collaborative Designs — may not be reproduced, copied, recreated, reverse engineered, digitized, authorized for reproduction, or provided to another manufacturer, maker, or third party without Fayette Studio's prior written permission.

Fayette Studio's Use of Its Designs. Unless otherwise agreed in writing, Fayette Studio may reproduce, distribute, display, modify, prepare derivative works from, adapt, license, and otherwise use its Designs for future collections, manufacture, sale, marketing, advertising, social media, editorial features, website content, and other promotional materials, in any media and throughout the world.

License to Use Client Photographs/Videos. By purchasing from Fayette Studio, the client grants Fayette Studio a non-exclusive, perpetual, worldwide, royalty-free license to use, reproduce, publish, and display photographs or videos of Fayette Studio rugs that are provided by the client or that the client otherwise authorizes Fayette Studio to use, including images shared directly with Fayette Studio or made publicly available by the client through the client's website or social media accounts. The client represents that it has all necessary rights and permissions to authorize this use and agrees to indemnify and hold Fayette Studio harmless from any claims arising from a lack of such permissions.

Nothing in these Terms transfers ownership of photographs to Fayette Studio. The client retains ownership of its photographs while granting Fayette Studio permission to use authorized images for promotional and marketing purposes.

Care & contact

Maintaining your rug

All rugs should be cleaned with a light suction only vacuum. Do not use a beater brush attachment as they can cause pulls and damage. Damage that occurs by not following this recommendation is the responsibility of the client. Professional cleaning is recommended as required.
