TERMS & CONDITIONS

By placing any order with Fayette Studio the customer agrees to the following terms and conditions. Terms and conditions are subject to change without notice. Please retain a copy of this page.

All orders are considered firm once Fayette receives a deposit. Deposits are non-refundable. Should Fayette Studio (“Fayette”) accept a cancellation of an order (which acceptance may be withheld by Fayette in its sole discretion), Fayette shall have the right to retain the full deposit paid for such order. If any exception is approved, only a store credit will be issued. Any costs associated with the order will be deducted . The remaining deposit balance will become a store credit which must be used within 6 months of issue date unless otherwise agreed to in writing. It is the client’s responsibility to request that the credit be used toward their next order.

CUSTOM ORDERS

Fayette will not entertain any request to accept the cancellation of any custom or special order.

Prices quoted/invoiced are applicable solely to the original order. Any changes in the scope of work (for example: pattern direction, delivery address change, materials used, pile heights) may result in a new quote and/or change of order. Prices are subject to change without notice and may be higher than what was originally quoted/invoiced.

A signed rendering/diagram is required for all custom orders. Once a full size final render is signed, no changes will be permitted.

STRIKE OFFS

For custom colors and custom patterns, we strongly advise making a strike off. Strike offs will ship approximately 4 weeks after a render is approved. Ombre or complicated designs take additional time. Strike off pricing will be on the estimate or invoice and any additional strike offs will be billed at that strike-off rate. If no strike off rate is listed, it is a $350 fee per strike-off. A strike off must be approved and a rendering must be signed within 30 days or pricing on the original invoice is subject to change.

When a strike off on a custom rug order is waived, the client is fully responsible for the delivered rug. The invoice must be paid in full before production.

NATURAL MATERIALS/HANDMADE PRODUCTS

Variations in color, quality and size are inherent to handmade rugs and are not considered manufacturing flaws but rather contribute to the unique quality of the handmade product.

Please note: Due to the nature of handmade products, we allow +/- 5% color and/or size variation after washing.

Exact sizes are typically not possible in handmade goods unless larger sizes are ordered and cut down after production. This is if the pattern allows and is at an additional cost. Please note that even cut downs may still have slight variation but will be as close to the ordered size as possible.

SHEARLINGS, LEATHER & FUR

Natural hides, leather and fur can vary in color, texture, softness and pile height. These variances are natural occurrences in skins/hides and therefore an exact match to your sample cannot be guaranteed. Natural hides should never be in direct sunlight and can fade/discolor. It is normal to have a slight odor cast off natural hides. It is expected for dyed hides to oxidize and change in color with age.

UNDYED WOOL

Natural wool colors can have variation in tonality and may not match control sample exactly. It is common for natural yarns to have striations and variation throughout the rug.

CUSTOM MACHINE MADE CARPETS AND RUGS

Although the mill does their best to keep dye lots consistent, standard colors can have dye lot variation between the strike off and the final carpet/rug.

STOCKED BROADLOOM

Dye lot variations are common and expected. CFAs are recommended and may incur a charge (for each cutting) depending on the mill. We can not be responsible for any color/pattern mistakes or color variations if a client refuses a CFA.

DELIVERY / INSTALLATION SCHEDULING AND DELAYS:

Please allow up to 6 weeks to schedule an installation or delivery. Fayette will do its best to accommodate your installation needs, but Fayette will not schedule an installation until the carpet and any necessary accompanying materials have been received and inspected.

A representative of the purchaser must be present (at the start of the scheduled time window) to instruct our crew. (For example: stair margins, rug placement and orientation) Fayette is not responsible and Purchaser is not relieved of its obligations where on-site conditions or limitations prevent delivery. If an installer arrives at the jobsite and it is not ready for installation/Delivery (at no fault of Fayette) because of circumstances on site (e.g., unreported extreme furniture entrance blockage, construction delays, etc) there will be a missed day fee/double delivery charge including if we need to come back to make adjustments due to lack of instruction.

Changes communicated less than two working days prior to a scheduled delivery or installation will result in a cancellation fee AND Fayette cannot guarantee the installation can be rescheduled within the customers desired timeframe.

Installers will not move furniture or rugs outside of the scope of the work order without prior agreement and confirmation of costs. Delivery and spread pricing on estimates and invoices are for standard furnishings. Any heavy, delicate or valuable furniture must be moved prior to the installer arriving onsite. Any undocumented heavy or extreme furniture will incur additional costs to be billed after the delivery/install. Gratuity is appreciated but not expected by our installers. Gratuity for extra work does not constitute payment for additional services.

Time windows for all installations are provided/confirmed the afternoon before the scheduled date. If you do not hear from our team for confirmation please email info@fayettestudio.com or call our studio (203-769-1617) before 5pm. If a more specific time frame is needed and the installer can accommodate, there may be an upcharge. Installers base their timing on location and provide a window of time which is not guaranteed due to factors outside of their control.

INCREASE IN LABOR COSTS

Installers have periodic increases in materials and labor costs. Any increases will be noted clearly and relayed to the client prior to installation/delivery.

CRATE COSTS

Oversize area rugs typically need to be crated in transit. This cost is typically communicated to Fayette once the rug has been woven. There are additional costs to break down and dispose of crates.

PAYMENT

A 50% non-refundable deposit is due to launch a custom strike-off. Once strike-offs are approved and a full size rendering is signed, we will begin production on your rug.

Balance payments are due in full upon request. Certain mills and all collaboration rugs require full invoice payment before rug production. For any rush orders, fees may apply, and the order must be paid in full. Rush order fees are nonrefundable and do not guarantee early delivery if circumstances beyond our control affect production time.

Fayette gladly accepts checks, bank transfers, wire transfers and credit cards. Please note, a 3% convenience fee will be applied for all credit card payments. If payment is not made within ten (10) days of the final payment notification, a late fee of 1.25% per month will be charged by Fayette.

If balance payments are not made within 3 months of request, Fayette has the right to cancel the order and retain the deposit. Customers will be liable for all reasonable costs, expenses, fees, including reasonable attorneys fees, incurred by Fayette in collecting monies due.

SHIPPING

Fayette cannot determine the exact shipping cost until the rug has shipped. Freight costs are estimates and may increase at or after the time of shipping. We will do our best to honor the price on our invoice, but Fayette reserves the right to adjust freight costs.

Quoted delivery dates are approximate dates only. Fayette shall not be responsible for any delay in delivery or failure in performance for any cause beyond Fayette’s direct control (including, but not limited to, labor disputes, failure or delay of sources to supply, transportation difficulties, health emergencies, accidents, fires, acts of nature or acts of God) or any event which interferes with Fayette’s or its vendors’ normal business operations.

STORAGE

We understand that sometimes clients are unable to take delivery right away. Any rug or carpet not accepted for delivery within (6) six weeks after notification that the rug or carpet is ready will be subject to storage fees. Storage fees will be added to the final bill and will be due as a balance due before delivery. Expect a minimum of $125 to re-inspect the rug plus a monthly charge of $50 per rug.

Fayette cannot be held responsible for any crushing, wrinkling, fading and/or any other issues that may occur after the product is in our possession past 30 days. Orders held past this timeframe may require additional services, such as blocking or cleaning, to ensure product quality. This will result in additional charges. Any issues arising from storage are not the responsibility of Fayette. Orders in Fayette’s possession in excess of 12 months must be delivered or will be canceled without refund.

CLAIMS

All claims against Fayette, including defects, shortages and errors must be made within five (5) working days after receipt of the merchandise. Failure to make any claim within such period shall constitute acceptance of the merchandise Fayette’s liability shall not exceed the sum actually paid by the customer to Fayette.

Once we have shipped or delivered a rug to a receiver, we cannot be held responsible for its condition after it has been stored at the receiver’s warehouse. We expect all rugs to be unrolled and inspected by the receiver within five days of receipt. We expect any issues to be communicated to us within this timeframe. We strongly recommend that if a rug is being stored for 30-days or more, that the commercial receiver open the rug for airing, grooming, and inspection prior to installation.

Any oral statements made by a Fayette employee or agent do not constitute warranties, are not a part of this agreement, and should not be relied upon.

CUSTOM DESIGN

Designs created by Fayette in collaboration with a client are considered Fayette's Intellectual Property, and Fayette holds the exclusive rights to reproduce, distribute, and display these designs as rugs without any further obligation to the client.

This clause extends to all collaborative efforts, and unless agreed upon in writing before creation, the client agrees not to make any claims for compensation.

MAINTAINING YOUR RUG

All rugs should be cleaned with a light suction only vacuum. Do not use a beater brush attachment as they can cause pulls and damage. Professional cleaning recommended for spills and annual maintenance.
